Terms of Service
Undumb is a product operated by FigLantern LLC. These Terms of Service (“Terms”) govern your use of the Undumb website, mobile applications, and related services (collectively, the “Service”).
By accessing or using the Service, creating an account, or purchasing a subscription, you agree to these Terms. If you do not agree, do not use the Service.
Our Privacy Policy explains how we handle information about you.
1. Eligibility and your account
You must be at least 13 years old to use Undumb. If you are under the age of majority where you live, you may use Undumb only with the permission of a parent or legal guardian.
You are responsible for providing accurate account information, maintaining the security of your account, and for activity that occurs through your account. Accounts and subscriptions are intended for individual use unless we expressly offer a plan that permits sharing.
2. What Undumb is
Undumb provides short workouts and exercises intended to challenge and practice skills such as Creativity, Critical Thinking, and Focus.
Undumb is an educational and general-wellness product. It is not a medical device or healthcare service and is not intended to diagnose, treat, cure, or prevent any medical or psychological condition. It is not a substitute for professional medical, psychological, educational, or other professional advice.
Individual experiences vary. Except for the Money-Back Guarantee described below, we do not promise that using Undumb will produce any particular cognitive, academic, professional, health, or other real-world outcome.
3. Free and paid features
Some portions of Undumb may be available without payment. Other features may require a paid subscription.
The price, subscription period, renewal terms, and features included with a paid subscription will be shown to you before you purchase it.
Prices may differ based on platform, country or region, currency, taxes, promotions, or other factors. A price offered through one purchase channel does not necessarily entitle you to the same price through another purchase channel.
4. Purchases across the website and app
Undumb is a multi-platform service. An active paid Undumb subscription purchased through our website or through a supported app marketplace may be recognized across the Undumb platforms we support, including the website and mobile app, when you are signed into the Undumb account associated with that purchase.
Where technically supported, you do not need separate subscriptions simply because you use both the website and the app.
The platform through which you originally purchased your subscription remains responsible for processing that transaction, including billing, renewals, payment-method changes, and transaction refunds.
If you believe you have accidentally purchased overlapping subscriptions, contact hello@figlantern.com so we can help identify the subscriptions and the appropriate billing provider.
5. Auto-renewing subscriptions
Unless otherwise stated at the time of purchase, paid subscriptions automatically renew at the end of each subscription period until canceled.
Before you subscribe, we will show you the amount you will be charged, the subscription duration, and the renewal terms. You authorize the applicable billing provider to charge the payment method associated with your purchase for each renewal unless you cancel before the applicable renewal date.
Where required by law, we or the applicable billing provider will provide renewal reminders, price-change notices, or other subscription notices.
Website purchases. If you purchased directly from Undumb on the web, you can manage or cancel automatic renewal through your Undumb account or another online cancellation method we provide.
Apple App Store purchases. If you purchased through Apple’s App Store, Apple manages your subscription and billing. You can manage or cancel the subscription through your Apple account or Apple’s subscription-management tools.
Canceling a subscription stops future renewal charges. Unless otherwise stated, you will continue to have access through the end of the period you already paid for. Cancellation by itself does not normally provide a refund for an already-paid subscription period, except where required by law or under the Money-Back Guarantee below.
6. One-year money-back guarantee
We want people to feel comfortable giving Undumb enough time to determine whether it is useful to them.
Stick with the workouts for a year. If you don’t see improvement, get your money back.
Who is eligible. The guarantee applies to your first paid annual individual Undumb subscription, unless an offer expressly says otherwise. Monthly subscriptions and subsequent annual subscription terms are not covered unless we specifically state that they are.
Using Undumb during the year. The guarantee is intended for people who make a genuine, good-faith effort to use Undumb regularly during their first annual subscription period. We do not impose an undisclosed minimum number of workouts, a required streak, or a required score in order to qualify. We may review basic account activity to confirm that the Service was actually used and to prevent fraud or abuse of the guarantee.
What “improvement” means. Whether you saw improvement is based on your own good-faith assessment of your experience with Undumb, including skills such as Creativity, Critical Thinking, or Focus. You do not need to demonstrate a clinical, medical, academic, employment, or standardized-test outcome. The guarantee is a refund promise, not a representation that Undumb is clinically proven to improve cognition or that every user will achieve a particular result.
When to make a claim. You may make a guarantee claim within 30 days after the end of your first annual subscription period. Contact hello@figlantern.com and identify the Undumb account associated with your subscription. We may ask for reasonable information necessary to locate or verify the purchase.
You may turn off automatic renewal at any time before your first annual subscription ends without losing eligibility for the guarantee. Canceling automatic renewal does not shorten the subscription period you already paid for.
What we will refund. For an approved claim, the guarantee covers the full amount actually paid for your first annual Undumb subscription. The guarantee is limited to one claim per person and is not available for fraudulent, abusive, or materially misrepresented claims.
Website purchases. If you purchased directly from Undumb, we will ordinarily return the covered amount to the original payment method.
Apple App Store purchases. Apple controls transaction refunds for purchases made through the App Store. We may direct you to request the transaction refund using Apple’s refund process. If Apple does not process an otherwise valid guarantee claim, contact us with the relevant purchase information and Apple’s decision. We will work with you to honor the economic value of the guarantee through a method permitted by applicable law and applicable platform rules.
Changes to the guarantee. If we change or discontinue this guarantee in the future, the guarantee terms presented when you began an eligible annual subscription will continue to apply to that subscription. We will not make the guarantee materially harder to claim after you have purchased it.
7. Other refunds
Except for the Money-Back Guarantee, refunds required by applicable law, or another refund policy expressly presented to you at purchase, subscription charges are non-refundable.
For purchases made through a third-party marketplace such as Apple’s App Store, transaction refunds are governed by that marketplace’s applicable policies and procedures. Nothing in these Terms limits any non-waivable refund, cancellation, withdrawal, or other consumer right provided by applicable law.
8. License to use Undumb
Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own non-commercial purposes.
You may not, except where applicable law expressly permits it, copy, sell, sublicense, rent, or commercially redistribute the Service or its content; reverse engineer, decompile, or attempt to extract source code; circumvent access controls or subscription restrictions; scrape substantial portions of the Service; interfere with its operation or security; impersonate another person; gain unauthorized access to another account; or use the Service unlawfully or to infringe another person’s rights.
9. Ownership
Undumb and its software, designs, exercises, text, graphics, branding, trademarks, and other materials are owned by FigLantern LLC or our licensors and are protected by intellectual-property laws. These Terms do not transfer ownership of any Undumb intellectual property to you.
If you voluntarily send us ideas, suggestions, or feedback about Undumb, you allow us to use that feedback without restriction or compensation to you.
10. Third-party services
Undumb may rely on or interact with third-party services, including payment processors, app marketplaces, authentication providers, analytics services, hosting providers, communications providers, and other technology providers. Those services may be governed by their own terms and privacy policies.
We are not responsible for third-party services outside our control, although this does not affect responsibilities we cannot disclaim under applicable law.
11. Privacy
Our collection and use of personal information is described in our Privacy Policy.
Account deletion does not cancel a subscription. Minimal billing ownership and transaction records may remain as described in our Privacy Policy. Billing recovery never restores deleted workout or profile data. Subscription management and support remain available at undumb.app/support.
12. Changes to the Service
We may improve, add to, modify, or discontinue features of the Service over time. We do not promise that any particular feature will remain available forever. If a change materially affects a paid subscription, we will comply with any notice or other obligations required by applicable law.
13. Suspension and termination
You may stop using Undumb at any time.
We may suspend or terminate access to the Service if we reasonably believe you have materially violated these Terms, engaged in fraud or abuse, compromised the security or operation of the Service, or used the Service unlawfully. Where appropriate, we will attempt to provide notice before terminating a paid account unless immediate action is reasonably necessary.
Termination does not limit any consumer rights that cannot lawfully be waived.
14. Disclaimers
Except for the express Money-Back Guarantee in these Terms and any warranties that cannot legally be excluded, the Service is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will always be available, uninterrupted, error-free, or perfectly accurate.
Some jurisdictions do not permit certain warranty exclusions, so some of these provisions may not apply to you.
15. Limitation of liability
To the maximum extent permitted by applicable law, neither FigLantern LLC nor its officers, employees, contractors, or affiliates will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Service.
To the maximum extent permitted by applicable law, our aggregate liability for claims arising out of or relating to the Service will not exceed the greater of (a) the amount you paid for Undumb during the 12 months immediately preceding the event giving rise to the claim or (b) US $100.
Nothing in these Terms excludes or limits liability to the extent that such liability cannot lawfully be excluded or limited. Some jurisdictions do not allow particular exclusions or limitations of liability, so some of these limitations may not apply to you.
16. Apple App Store
If you download or use Undumb through Apple’s App Store, your license to the iOS application is also subject to Apple’s Licensed Application End User License Agreement unless a different license is expressly provided.
These Terms govern your Undumb account, the Undumb Service, subscriptions, and our relationship with you. Apple’s applicable terms govern matters that Apple controls, including the App Store transaction and the license terms imposed by Apple. Apple is not responsible for providing the Undumb Service or for our Money-Back Guarantee.
17. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles, except to the extent that applicable law where you reside gives you rights that cannot be waived by contract.
Subject to any rights you have under applicable law to bring a dispute elsewhere, any dispute arising from or relating to these Terms or the Service will be brought in the applicable state or federal courts located in the City and County of San Francisco, California.
18. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will provide notice when required by law. Your continued use of the Service after an updated version becomes effective constitutes acceptance of the updated Terms, except where applicable law requires another form of consent.
Changes will not retroactively reduce rights under the Money-Back Guarantee associated with an eligible subscription you already purchased.
19. General terms
If a provision of these Terms is held unenforceable, the remaining provisions will remain in effect to the extent permitted by law. Our failure to enforce a provision does not waive our right to enforce it later.
You may not transfer your rights or obligations under these Terms without our permission. We may transfer these Terms as part of a merger, acquisition, corporate reorganization, or sale of the business or relevant assets.
These Terms, together with any additional terms expressly presented for a particular feature or purchase, constitute the agreement between you and us concerning the Service.
